Terms of Service
1. Acceptance of Terms
By accessing or using the Luxe Photos Pixieset gallery, you agree to comply with these Terms of Service. If you do not agree, you must not access or use the gallery.
2. Booking and Payment
To secure a session, a non-refundable deposit of 35% is required. The remaining balance must be paid before or on the day of the session.
3. Cancellations and Rescheduling
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Changes made within 48 hours may be subject to an additional fee.
In case of extreme weather or unforeseen circumstances, rescheduling will be allowed at no additional cost.
4. Photo Delivery
Final images will be delivered through the online gallery (Pixieset) within 3 to 7 days after the session.
Luxe Photos is not responsible for delays due to technical issues beyond our control.
5. Use of the Gallery
The Pixieset gallery is intended for clients, collaborators, and authorized viewers only.
You may:
view and download images for personal use only (if allowed by the session agreement)
share images with friends or family for personal purposes
You may not:
copy, alter, or redistribute images without permission
use images for commercial purposes unless expressly authorized
access the gallery for any unlawful purpose
6. Image Usage
Luxe Photos reserves the right to use images for portfolio, website, social media, and promotional purposes unless the client explicitly requests otherwise in writing before the session.
7. Copyright
All images are protected under copyright. Clients receive a personal-use license only.
Commercial use, reproduction, or alterations are not permitted without written consent.
8. Editing
Images will be delivered professionally edited in Luxe Photos’ signature style.
Raw (unretouched) files will not be provided.
Additional editing requests may incur extra charges.
9. Liability Waiver
Luxe Photos takes all reasonable precautions to ensure a safe environment during photo sessions.
However, clients participate at their own risk. Luxe Photos is not responsible for any injuries, falls, damages, losses, or accidents that may occur during the session, whether on public or private property.
By booking, the client acknowledges full responsibility for their own safety and the safety of any companions.
10. Account and Security
If a login or password is required to access your gallery, you are responsible for keeping your credentials secure.
You must notify Luxe Photos immediately of any unauthorized access.
11. Technical Issues
Luxe Photos is not responsible for:
gallery downtime or technical failures
third-party service interruptions
loss of images due to hardware, software, or network errors
12. Limitation of Liability
Maximum liability is limited to the fees paid for the photography session related to the gallery content.
Luxe Photos is not liable for indirect, incidental, or consequential damages, including lost opportunity, emotional distress, or printing errors.
13. Changes to Terms
Luxe Photos reserves the right to update or modify these Terms at any time.
Changes take effect immediately upon posting in the gallery.
